These Website terms and conditions of use (“Terms of Use”) describe the legal conditions that apply to any Internet user visiting the Workplace Safety North (“we”, “us”, “our”, or “WSN”) website or the website of (hereinafter referred to as the “Websites”). By consulting the Websites, you agree to be bound by and comply fully with these Terms of Use. If you do not wish to agree to these Terms of Use, you must not access or use the Websites. We advise you to consult these conditions regularly as they can be modified at any time without warning. Any change to these terms and conditions of use will take effect immediately after it is published and will be immediately opposable to third parties.
Nature of the information
WSN makes every effort to ensure that the information available on the Websites is accurate and up-to-date, and reserves the right to modify the content of the Websites at any time without prior notice.
We have compiled the content of the Websites with the greatest possible care. However, the Websites are provided for informational purposes only and cannot guarantee that the content of the Websites is correct, accurate, current, updated and complete, that the Websites will function uninterrupted and/or will be free of errors.
Visitors who rely on the information contained on the Websites do so entirely at their own risk. Cancellations, Payments, and Refunds
WSN takes all reasonable steps to avoid cancelling its classes. WSN will generally only cancel courses and appointments in circumstances beyond its control, such as severe weather events, which make it is unsafe for learners to travel to a training location. In the event of a class cancellation, you will be contacted on the same day to make alternate arrangements.

If you would like to request a refund for the training or product that you purchased, please contact Customer Care. A member of our Client Care team will contact you regarding your refund request, and may request your order confirmation number or other information to assess your eligibility for a refund. Please note that refunds from credit card transactions can only be sent back using the original payment method.
Training Purchases
If you purchased training, you may cancel your registration for training up to one week prior to the date and time the class was scheduled to start and receive a full refund or full credit to be used towards a future course.
If you do not meet the necessary prerequisites for a course, you will not be able to participate. If you enroll in a class for which you have not completed the necessary prerequisites, you will only be eligible for a refund if you cancel your registration for training least one week prior to course start date and time.
You may transfer your enrollment in a particular training to a different person by contacting WSN Training at least 48 hours before the start of the training session. Please ensure the person to whom you are transferring your enrollment has completed the required prerequisites. If the person to whom you are transferring your enrollment has not completed the required prerequisites, they will not be permitted to participate.
Shopping Cart
In-person training courses and events have limited seating. In order to ensure that the maximum number of individuals are able to participate in in-person training sessions, individuals are required complete their registration for a course within 24 hours of selecting the course (placing the course in their virtual “shopping cart”). Individuals that fail to complete registration within 24 hours of placing a course in their shopping cart will need to restart the registration process.
Product Purchases
If a product that you purchased from us is damaged or malfunctions, you can request a refund within 14 days of receipt of the item. Please contact us at customercare@workplacesafetynorth.ca if you would like to return a product.
E-Learning
If you purchased e-learning, you will receive detailed instructions on how to access your course (and login instructions) via email within 30 minutes of your purchase.
Privacy Policy
This policy describes how we collect, use, disclose, and otherwise process the Personal Information of individuals who access and use our website ("Website"). By accessing and using the Website, contacting us, or engaging in Training, you consent to us collecting, processing, and disclosing your information as described in this Policy.
This privacy policy applies to any Personal Information collected via a visit to this website and its constituent pages (collectively, the “Website”) and/or to any Personal Information collected in the course of (or subsequent to) providing or administering training services (“Training”). For the purposes of this policy, “Personal Information” includes any information about an identifiable individual or an individual whose identity may be inferred or determined from such information, that can be used on its own or with other information to identify a single person, but does not include names, titles or other information that is publicly available, such as business contact information or information found in a telephone directory.
We strongly recommend that you read this policy carefully and retain it for future reference. This policy may change from time to time, so please check this policy periodically for updates. Your continued use of our Website and/or any of our services after we make changes to this policy indicates that you accept and consent to those changes.
The application of this policy is subject to applicable laws, including legislation, regulations and the orders or lawful requests of any courts or legal authorities. If we need to collect, use, or disclose your Personal Information or Personal Health Information in a way that is not identified or anticipated by this policy, we will notify you and/or obtain your consent as required under applicable privacy laws.
By submitting Personal Information to WSN or its agents, you agree that they may collect, use and disclose such Personal Information in accordance with these Terms and Conditions and as permitted or required by law. You may vary or withdraw your consent to the use and disclosure of your Personal Information, or opt-out of certain uses and disclosures, subject to legal and contractual restrictions. In certain instances, WSN may require you provide additional information to verify your identity before your request is processed.
Information Collected on our Website
This Website does not require users to provide Personal Information to browse the site. However, in certain instances, such as when you decide to contact Workplace Safety North or Ontario Mine Rescue, subscribe to newsletters, access online resources, or book or purchase services and products, you may be asked to provide your Personal Information, such as your name, e-mail address, phone number, address, the name and address of the organization you are affiliated with, your designation or title within the organization, and if applicable, payment and billing details, and other similar information.
If you provide WSN or its agents with Personal Information of another individual, you represent that you have all necessary authority and/or have obtained all necessary consents from such person to enable WSN to collect, use and disclose such Personal Information for the purposes set forth in these Terms.
As you navigate through and interact with our Website we may use automated technologies, such as “cookies”, small files placed on your hard drive or computer, to collect certain information about you, your device, and how you interact with our Website. This information includes device information (brand, category, model, operating system type and version), browser type, IP address, location, time spent on the Website, content viewed, and other similar information. WSN uses these technologies to track, analyze, and improve the use of the Website and its products and services. WSN may use the information gathered by these tracking technologies to ensure that the Website is functioning adequately, to understand the adoption of the Website and its products and services, and to support the consistent and effective use of the Website by its visitors.
Information Collected by Providing or Administering our Training
We may collect Personal Information from you in the course of (or subsequent to) providing or administering our Training. For example, we may collect Personal Information such as:
- Your name
- Your contact information (mailing address, email address, and telephone number).
- Your year of birth.
- Your employment information.
- Your demographic information.
- Other information that you voluntarily provide in the course of registering or receiving Training, or subsequent to receiving Training, including personal health information to confirm your fitness to undertake certain training.
- Information that you provide in the course of communications we have with you.
How we use and disclose your Personal Information
We use information that we collect about you or that you provide to us, including Personal Information, for purposes that include:
- To make our Website and its contents available to you and to improve our Web.
- To register you for our Training and to administer our Training.
- To process payment for our Training.
- To communicate with you regarding our Training or any other matters for which you contact us.
- To assess and improve our Training.
- To comply with our obligations to the Ministry of Labour, Immigration, Training and Skills Development.
- To prepare disclosures to the Ministry of Labour, Immigration, Training and Skills Development, which may include de-identifying or anonymizing Personal Information.
- To carry out our obligations and enforce our rights.
- To fulfill any purpose described to you at or prior to the collection of Personal Information.
- As required or permitted by applicable law.
The Personal Information that we collect may be assigned to a successor entity in connection with a corporate merger, consolidation, sale of assets or other corporate change involving WSN or our Website. In such an event, we will attempt to notify you before your information is transferred.
We may disclose Personal Information that we collect or you provide as described in this privacy policy:
- To our service providers, such as third-parties who provide information technology services that facilitate our provision or administration of Training or support the maintenance of our Website.
- To carry out our obligations and enforce our rights.
- To fulfill any purpose described to you at, or prior to, the collection of Personal Information.
- As required or permitted by applicable law.
Surveys
Pursuant to Workplace Safety North’s agreement with the Government of Ontario’s Ministry of Labour, Immigration, Training, and Skills Development, we are required to circulate surveys to collect certain demographic information once participants complete a training session, after we provide consulting services, and after we host events. The data collected in this survey will be shared with the Government of Ontario to assist it in understanding the results and effectiveness of our training, consulting services, and events. Please note that only your age, gender, ethnicity, language spoken at home, sector, employment category (NOC code), your location of work (county/district), and business size will be shared with the Government of Ontario. We do not disclose other information, like your name, date of birth, or other identifiers.
Please note that these surveys are optional.
Third-Party Service Providers
WSN uses third-party service providers, such as Microsoft Azure to host data in Canada and the United States, track and prevent errors in our software, and send, receive and track emails. These third-party service providers may have access to Personal Information as an incidental result of the services provided by such third parties to WSN, but the access of such third parties to such information is strictly controlled in accordance with the safeguards detailed below.
Security
To help protect the confidentiality of Personal Information, WSN employs commercially reasonable administrative, physical, and technological safeguards appropriate to the sensitivity of the Personal Information. Where Personal Information is sent to a third party for processing, WSN ensures, through contractual agreements, that all Personal Information is kept secure. WSN operates secure data networks protected by an industry standard security system and password protection systems.
Retention of your Personal Information
Except as otherwise permitted or required by applicable law or regulation, we will only retain your Personal Information and Personal Health Information for as long as is necessary to fulfill the purposes for which we collected it on behalf of your health information custodian, and for certain other purposes including for the purposes of satisfying any legal, accounting or reporting requirements or to protect us from liability in the event of a dispute.
Changes to this privacy policy
We reserve the right to modify this policy at any time. The policy posted on our Website shall be deemed to be the policy in effect. A current policy can also be obtained by contacting us. If we make any material changes to this policy regarding how we treat your Personal Information we will notify you through a notice on our Website. We also include the date this policy was last revised at the top of the policy.
Correcting or updating information and withdrawing consent
It is important that the Personal Information and Personal Health Information we hold about you is accurate and current. The accuracy, integrity and completeness of your Personal Information and Personal Health Information you input into our Apps or allow someone to input into our Apps on your behalf, is your responsibility. Please keep us informed if your information changes.
By law, you have the right to request access to and to correct the Personal that we hold about you. You may contact us if you would like to review, verify, correct or withdraw consent to the use of your Personal Information. We may request certain Personal Information for the purposes of verifying the identity of the individual seeking access to their Personal Information.
We may not accommodate a request to view or change information if we believe that:
- The identity of the person requesting access cannot be confirmed;
- The information is not readily retrievable, and the burden or cost of providing it would be disproportionate to the nature or value of the information;
- The requested information does not exist, is not held or cannot be found;
- Disclosure of the information would compromise the confidentiality of another individual or threaten the safety of another person; and/or
- Non-disclosure of the information is required or permitted by law.

By completing this survey, you agree to Workplace Safety North’s collection of this information, and that Workplace Safety North may provide the personal information described above to the Government of Ontario.
